Terms of Service

1. About these terms

These Terms of Service ("Terms") govern your use of ChatAIMax, available at app.chataimax.com, and of the chataimax.com website (together, the "Service"). The Service is provided by Digital Talents LLC ("we", "us"), a limited liability company registered in Delaware, United States, with its registered address at 16192 Coastal Highway, Lewes, Delaware 19958, United States.

2. Acceptance

To create an account you must accept these Terms. If you do not agree with them, do not use the Service.

Our Privacy Policy and Refund Policy form part of these Terms.

3. Who can use the Service

You must be at least 18 years old to use the Service. If you use it on behalf of an organization, you confirm that you are authorized to accept these Terms for it.

4. Your account

You must provide accurate information and verify your email address before sending your first message. You are responsible for keeping your password secure and for the activity under your account.

Accounts are personal. Do not share them or create several accounts to get around plan limits. Tell us right away if you believe someone has accessed your account without permission.

5. What the Service does

ChatAIMax lets you send prompts to AI models offered by third-party providers, such as OpenAI, Anthropic, Google and xAI, through three modes: Chat, Compare and Max Mix.

The models available to you depend on your plan and on what each provider offers. Providers may change, limit or discontinue their models, and we may add, change or remove models and features. We will try to keep the Service available, but we do not guarantee that it will be uninterrupted or error-free.

6. Free and PRO plans

There are two plans:

• Free: a trial to get to know the product. It includes Chat with a selection of lower-cost models and a one-time starter allowance that does not renew. It does not require a payment method.
• PRO: a paid subscription with Chat, Compare and Max Mix, a wider selection of models, attachments on compatible models and a usage allowance that renews each billing period.

Usage is measured in credits. Each model uses credits according to its cost, so the number of messages you can send varies. PRO is not unlimited. Credits are a usage allowance: they have no cash value, cannot be transferred and do not carry over to the next period.

The current limits of each plan are shown in the app.

7. Billing and renewal

PRO price and billing period: USD 29 / month. PRO renews automatically every month until you cancel it. Taxes may apply depending on your country.

Payments are processed by a third-party payment provider, which is shown when you check out. The price, billing period, renewal and applicable conditions are shown before you confirm a purchase.

8. Cancellation

You can cancel your PRO subscription at any time to stop the monthly renewal, from the billing section of your account in the app or by writing to support@chataimax.com. You keep PRO until the end of the month you have already paid.

Cancelling is not the same as requesting a refund. Refunds are covered by the Refund Policy.

9. Acceptable use

You may not use the Service to:

• create, request or share content that sexualizes minors;
• break the law or infringe the rights of others, including intellectual property and privacy rights;
• harass, threaten or incite violence against people or groups;
• develop malware, commit fraud or obtain unauthorized access to systems or data;
• breach the usage policies of the AI providers whose models you use;
• get around plan limits, resell access, or access the Service by automated means other than its interface;
• interfere with the security or operation of the Service.

10. Moderation, suspension and termination

Messages are checked by an automated moderation service before they are sent to a model. A message that breaks these Terms may be blocked.

Depending on the severity and repetition of violations, we may suspend an account temporarily or permanently. Content that sexualizes minors leads to immediate suspension. Unusual usage that suggests abuse of the Service may lead to a temporary technical suspension.

While suspended, you may still be able to sign in to read, export and delete your data, unless the law or the severity of the case requires otherwise. If you believe a decision is wrong, write to us at support@chataimax.com.

You can stop using the Service and delete your account at any time from the app.

11. Your content and AI outputs

You keep the rights you have over the content you send ("inputs"). You give us permission to store, process and send it to the providers and services needed to run the Service, as described in the Privacy Policy.

As between you and us, we do not claim ownership of the responses the models generate for you ("outputs"). Your use of outputs is subject to the law and to the terms of the relevant providers. Outputs may not be unique, and other users may receive similar ones.

You are responsible for your inputs and for how you use outputs.

12. Limits of AI

AI models can produce inaccurate, incomplete, outdated or biased responses. Outputs are not professional advice (legal, medical, financial or otherwise). Review important information before relying on it.

Max Mix combines the perspectives of several models; it does not check facts. Agreement between models is not proof, and a synthesis is not guaranteed to be more accurate than a single model.

13. Third parties and trademarks

GPT, Claude, Gemini and Grok are trademarks of their respective owners. ChatAIMax is not affiliated with or endorsed by them. The providers operate their models under their own terms.

14. Our intellectual property

The ChatAIMax software, design, name and logo belong to us or our licensors. These Terms do not give you any right to them beyond using the Service.

15. Disclaimers and liability

The Service is provided "as is" and "as available", to the extent permitted by law.

Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

16. Changes to these Terms

We may update these Terms. We will publish the new version with its date and, for important changes, notify you in advance through the app or by email. If you continue to use the Service after the changes take effect, the new version applies.

17. Governing law

These Terms are governed by the laws of the State of Delaware, United States, and disputes will be heard by the competent courts of Delaware. This does not deprive you of the protection of the mandatory consumer laws of your country of residence.
